The Court of Appeal sitting in Kaduna,
has dismissed a case between Governor Rabi’u Musa Kwankwasa of Kano
State and two others over his eligibility to have contested as governor.

Indabawa and Suleiman Mohammed are contesting Kwankwaso’s eligibility to
contest the governorship position of the state.
Counsel to Indabawa, had filed a motion on notice seeking the disqualification of Kwankwaso from contesting the 2011 gubernatorial election of Kano State on the basis that he lied on his nomination form.
In his ruling on Monday, which lasted for one hour, the judge, Justice Habeeb A. O. Abiru, dismissed the case with appeal No. CA/K/77/2012 and referred the parties back to the Kano State Federal High Court, saying the court had no jurisdiction to hear the case.
However, speaking with our correspondent in the court premises, counsel to Governor Kwankwaso, Musa Lawal said, “we are going back to the Kano State Federal High Court to continue with the matter, even though we still have an option to go further. If we feel that we should go further then we will take the discussion.”
Also, counsel to Indabawa, Abdul Adamu said if his client has given him the go ahead, to take the matter to the Supreme Court to challenge the ruling of the Court of Appeal.
He said as far as the Court of Appeal was concerned, it affirmed the judgement delivered by the lower court.
